These Terms of Service ("Terms") are a binding agreement between you and the operator of Talking Stage ("Talking Stage," "we," "us," or "our"). They govern the Talking Stage mobile app, website, and related services (together, the "Service"). By downloading, accessing, purchasing, or using the Service, you agree to these Terms and our 隱私權政策. If you do not agree, do not use the Service.

Eligibility and accounts

You must be at least 17 years old, meet any higher minimum age required where you live, and be legally able to enter a binding agreement. If you do not meet these requirements, do not use the Service. You must provide accurate account information, keep your device and credentials secure, and promptly notify us of suspected unauthorized access. You are responsible for activity under your account.

You may not transfer, sell, share, or misuse an account. We may require identity or age verification where reasonably necessary for safety, legal compliance, account recovery, or a privacy request.

What the Service does

Talking Stage provides educational dating and relationship-skill lessons, practice tools, saved profiles and memories, reminders, suggestions, and AI-assisted features such as conversation practice, message drafting, screenshot analysis, lesson feedback, memory extraction, and personalized ideas. Some features require an account, network access, device permission, or paid subscription and may not be available in every region or at all times.

The Service does not connect you with dates, verify another person's identity or intentions, monitor real conversations, predict relationship outcomes, or act on your behalf. Stock and AI personas are simulations, not real people. You remain solely responsible for your communications, meetings, choices, safety, and compliance with law.

AI features and output

Artificial-intelligence output is generated probabilistically and may be inaccurate, incomplete, biased, offensive, outdated, unsuitable, or similar to output provided to others. It may misunderstand tone, screenshots, context, identity, consent, culture, safety risk, or another person's intentions. We do not promise that output is original, correct, effective, safe, or fit for a particular purpose, and you must independently review it before use.

AI output is for general education and practice only. It is not medical, mental-health, legal, financial, investigative, emergency, or other professional advice; diagnosis or treatment; a factual assessment of another person; or a guarantee or prediction of attraction, consent, compatibility, or relationship results. Do not use it to make high-stakes decisions. If you or another person may be in danger, contact local emergency services or an appropriate qualified professional rather than relying on the Service.

You must not represent AI output as another person's actual words, use it to impersonate someone, automate deceptive communications, manipulate or pressure anyone, infer sensitive traits, or evade another person's boundaries. Consent must be freely given and ongoing; no suggestion from the Service replaces consent. You assume the risk of using, sending, publishing, or relying on output.

Your content and other people's privacy

“Your Content” includes anything you submit, save, import, dictate, attach, or generate through the Service, including profiles, notes, memories, messages, lesson responses, screenshots, images, and feedback. As between you and Talking Stage, you retain any rights you have in Your Content. You grant us a worldwide, non-exclusive, royalty-free license to host, copy, transmit, process, adapt, display, and otherwise use Your Content only as reasonably necessary to operate, secure, support, and improve the Service, provide requested AI features, enforce these Terms, and comply with law. This license ends when the content is deleted from active systems, subject to reasonable backup, security, and legal-retention periods.

You represent and warrant that you have all rights and permissions needed to provide Your Content and permit this processing. You are responsible for its legality, accuracy, and appropriateness. Messages, screenshots, contacts, photos, and private details may belong to or identify another person. Do not submit them without a lawful basis and any permission reasonably required. Minimize sensitive information, and never submit intimate images without the depicted adult's explicit consent.

Feedback or suggestions about the Service may be used without restriction or compensation, provided we do not publicly identify you without permission.

You may use the Service only for lawful, personal, non-commercial purposes and in accordance with these Terms. You may not use it to harass, stalk, threaten, exploit, discriminate against, defame, deceive, shame, blackmail, surveil, dox, groom, traffic, or harm anyone; facilitate abuse, coercive control, sexual exploitation, or non-consensual conduct; create or share child sexual-abuse material or sexual content involving a minor; upload illegal, infringing, malicious, or privacy-invasive material; impersonate another person or misrepresent affiliation; scrape, harvest, sell, or build dossiers from personal data; make automated or bulk communications; develop or train a competing model or service from output or content; reverse engineer, probe, bypass, overload, or disrupt the Service or its safeguards; gain unauthorized access; introduce malware; or violate applicable law, another person's rights, Apple's rules, or third-party terms.

You may not use output as evidence of another person's conduct, mental state, identity, fidelity, guilt, health, or intent. You may not use the Service for employment, housing, credit, insurance, education admissions, law enforcement, immigration, biometric identification, or other eligibility or high-impact decisions.

We may investigate suspected misuse and remove content, restrict features, preserve evidence, suspend or terminate access, and report conduct to service providers or authorities when reasonably necessary or legally required. We are not obligated to monitor all content and cannot guarantee that safeguards will detect every harmful request or output.

Subscriptions, trials, and billing

Paid access may be offered through an automatically renewing Apple in-app subscription. The price, billing period, trial terms, and included features shown at purchase are part of these Terms. Payment is charged to your Apple account when you confirm. Your subscription renews unless canceled through your Apple subscription settings before renewal within the period Apple specifies. Deleting the app or your Talking Stage account does not automatically cancel billing.

Apple processes payment, renewal, cancellation, and refund requests under its terms and policies. We do not control Apple's decisions. Unless required by law, fees are non-refundable and there are no credits for partially used periods. Trials may convert to paid subscriptions unless timely canceled. Promotional terms may be changed or withdrawn as permitted by law. You are responsible for taxes and for reviewing the displayed price before confirming.

We may change subscription prices or features prospectively, with notice or consent where required. If access cannot be verified because of an outage, account mismatch, expired entitlement, or platform issue, use Restore Purchases or contact support.

License and intellectual property

Subject to these Terms, we grant you a limited, personal, revocable, non-exclusive, non-transferable, non-sublicensable license to use the object-code version of the Service on devices you own or control for its intended purpose. Talking Stage and its licensors own the Service, including its software, curriculum, branding, designs, databases, and documentation. Except for the limited license above and your rights in Your Content, no rights are granted to you.

You may not copy, modify, distribute, sell, lease, sublicense, publicly display, create derivative works from, or exploit the Service except where applicable law expressly prohibits that restriction. Third-party software and content may be governed by separate terms.

The Service relies on third parties, including Apple, Google, Supabase, OpenAI, Superwall, analytics and diagnostics providers, and providers of maps, locations, links, or recommendations. Their products, content, availability, and data practices are controlled by them and may be subject to separate terms. We do not endorse, control, or guarantee third-party services or places, products, prices, hours, safety, or availability. Verify recommendations directly before relying on them.

Privacy

Our Privacy Policy explains how information is handled, including information sent to AI and other service providers. By using the Service, you acknowledge those practices. Where consent is legally required, we will request it separately; agreement to these Terms does not replace that consent.

Service changes, availability, and beta features

We may add, change, limit, suspend, or discontinue features or the Service, and may set usage or storage limits. We do not guarantee uninterrupted availability, compatibility, preservation of content, or continued support for a device or operating system. Back up information you cannot afford to lose. Preview, experimental, or beta features may be less reliable and may change without notice.

WE DO NOT WARRANT THAT THE SERVICE WILL BE SECURE, UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS; THAT CONTENT WILL BE PRESERVED; OR THAT OUTPUT OR RESULTS WILL BE ACCURATE, SAFE, UNIQUE, OR SUCCESSFUL.

Some jurisdictions do not allow certain warranty exclusions, so some of the above may not apply to you. You may have rights that cannot be waived.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TALKING STAGE, ITS OPERATOR, AFFILIATES, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES; LOSS OF DATA, PROFITS, REVENUE, BUSINESS, GOODWILL, OR OPPORTUNITY; PERSONAL OR RELATIONSHIP OUTCOMES; CONDUCT OF YOU OR ANOTHER PERSON; OR DAMAGES ARISING FROM RELIANCE ON AI OUTPUT, EVEN IF ADVISED OF THE POSSIBILITY.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THEIR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOR TALKING STAGE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY OR (B) US $50.

These limits apply regardless of the theory of liability and even if a remedy fails of its essential purpose. They do not exclude liability that cannot lawfully be excluded, which may include liability for fraud, willful misconduct, or death or personal injury caused by negligence in some jurisdictions.

Indemnity

To the extent permitted by law, you will defend, indemnify, and hold harmless Talking Stage, its operator, affiliates, licensors, and service providers from third-party claims, damages, losses, liabilities, judgments, costs, and reasonable legal fees arising from Your Content, your use or misuse of the Service or output, your communications or conduct, your violation of these Terms or law, or your infringement of another person's rights. This obligation does not apply to the extent a claim was caused by the indemnified party's own unlawful conduct and does not limit non-waivable consumer rights.

Suspension and termination

You may stop using the Service and delete your account at any time. We may suspend, limit, or terminate access immediately if you materially or repeatedly violate these Terms; create legal, safety, security, or reputational risk; fail to pay applicable charges; or if necessary to comply with law or a provider requirement. Where practicable and legally appropriate, we will provide notice. Upon termination, your license ends. Provisions that by their nature should survive-including ownership, disclaimers, liability limits, indemnity, and dispute provisions-will survive.

Governing terms and disputes

These Terms and any dispute are governed by the laws applicable where the operator of Talking Stage is established, without regard to conflict-of-law rules, except that mandatory consumer protections and venue rights in your place of residence remain unaffected. Before filing a formal claim, you and Talking Stage agree to make a good-faith effort for 30 days to resolve it informally by emailing the contact below with a description of the dispute and requested resolution. Either party may seek urgent injunctive relief where appropriate.

If any provision is unenforceable, it will be limited to the minimum extent necessary and the remainder will continue. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a reorganization, financing, merger, acquisition, or transfer of the Service. These Terms, the Privacy Policy, and purchase terms are the entire agreement about the Service and supersede prior statements on that subject.

Changes to these Terms

We may update these Terms as the Service or law changes. We will update the date above and provide additional notice when required. Material changes apply prospectively. If you do not agree to updated Terms, stop using the Service and cancel any subscription; continued use after the effective date constitutes acceptance to the extent permitted by law.

Account deletion and contact

You can request account deletion at talkstageapp.com/delete-account. For questions, notices, or an informal dispute, email hello@talkingstageapp.com. Deleting an account does not cancel an Apple subscription; manage billing separately in your Apple account.
